Written Agreement
Eyezone Pty Ltd uses the Sample Locum Agreement published by OAA NSW/ACT Division. This agreement confirms the contracting of bona-fide locum services to the hirer. In addition to other matters, the agreement states the commencement and the very important termination date of the locum assignment.
The agreement is to protect you the hirer by reducing the possibility of the arrangement being overturned in the future into an employment contract and to reduce misunderstandings.
Without an agreement the relationship could be construed to that of an employer and employee. In which case you may become liable for: pay as you earn tax; statutory superannuation contributions; workers' compensation contributions; pay in lieu of annual leave; pay in lieu of public holidays; pay in lieu of sick leave; and termination pay.
